Affiliate Terms and Conditions
These terms and conditions (“Terms”) govern your participation in the affiliate program (“Affiliate Program”) offered by 2B Played Music (“Company”).
By participating in the Affiliate Program, you agree to abide by these Terms. If you do not agree with any of these Terms, please do not join or continue your participation in the Affiliate Program.
1. Enrollment in the Affiliate Program
1.1. To become an affiliate (“Affiliate”) of the Company, you must submit a completed application through our website or designated platform.
1.2. The Company reserves the right to accept or reject any application to join the Affiliate Program at its sole discretion.
2. Affiliate Responsibilities
2.1. As an Affiliate, you will be responsible for promoting 2B Played Music’s products or services in compliance with these Terms and any additional guidelines provided by the Company.
2.2. You agree not to engage in any deceptive, misleading, or unethical marketing practices in promoting 2B Played Music’s products or services.
2.3. You are responsible for ensuring that your marketing materials comply with all applicable laws and regulations.
3. Commission Structure
3.1. The Company will pay commissions to Affiliates based on qualified referrals or sales generated through their unique affiliate links or tracking codes.
3.2. The commission is calculated as 15% of the total sales amount, excluding taxes or VAT.
3.3 The commission rate of 15% applies to the total sales amount attributed to the tracking cookie placed by the first affiliate, which remains active for a period of fourteen days. Taxes or VAT are excluded from this calculation.
3.4 Affiliate links use tracking cookies that remain active for a period of 14 days. This means that if a customer makes a purchase within 14 days after clicking your affiliate link, the sale will be attributed to you, even if the purchase is completed at a later time. The cookie will only be attributed to the first affiliate link clicked during this period.
3.5 If a customer completes an order in a currency other than EUR, the order amount will automatically be converted to EUR based on exchange rates updated hourly from a reliable third-party source. Affiliate commissions will always be calculated based on the converted EUR amount, not the original currency.
3.6 Subscriptions billed on a recurring basis, including any installment payment plans (e.g., pay-in-3 offers), are not eligible for affiliate commissions at this time. All payments associated with such subscription structures are excluded from the Affiliate Program. This policy is subject to change at the sole discretion of the Company.
4. Payment
4.1. Commissions earned through the Affiliate Program will be calculated from the first to the last day of each calendar month. Affiliates will receive a sales report detailing their earnings within the first 3 weeks of the new month only if the minimum threshold of 50 euros is met. Once the threshold is reached and the sales report is sent, affiliates can submit an invoice for payment. Payments will be made exclusively in euros via PayPal. If the minimum threshold is not reached, earnings will be carried over to the next month.
4.2. Payments will be made exclusively in euros via PayPal. Other payment options and currencies are not available.
4.3. Commissions earned will only be paid out after a waiting period of thirty days, provided that the minimum threshold of 50 euros has been reached. This waiting period is to ensure transaction stability and the processing of any refunds, cashback claims, or customer issues. If an order is reversed or deemed fraudulent within this thirty-day period, the earned commission will be cancelled.
4.4. Affiliates must have received a sales report detailing their earnings in order to submit an invoice for payment. Once the invoice is received, the Company will process and make the payment within a maximum timeframe of 30 to 60 days.
4.5. The Company reserves the right to withhold or cancel payments for commissions that are deemed fraudulent, suspicious, or in violation of these Terms.
5. Termination
5.1. Either party may terminate the Affiliate Agreement at any time, with or without cause, by giving written notice to the other party.
5.2. Upon termination, you must immediately cease all marketing activities related to 2B Played Music’s products or services and remove any promotional materials containing 2B Played Music’s branding or trademarks.
6. Modifications
6.1. The Company reserves the right to modify, suspend, or terminate the Affiliate Program or these Terms at any time, with or without prior notice.
6.2. It is your responsibility to review these Terms regularly for any updates or changes.
7. Limitation of Liability
7.1. The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your participation in the Affiliate Program.
8. Governing Law
8.1. These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles.
9. Entire Agreement
9.1. These Terms constitute the entire agreement between you and 2B Played Music regarding your participation in the Affiliate Program, superseding any prior agreements or understandings, whether oral or written.
By joining our Affiliate Program, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
